What is a Notary?

A Notary Public is a legal professional appointed by the Supreme Court of NSW with the authority to witness the signing of important documents, certify copies of original documents, and administer oaths and affirmations. It is important to note that a notary in NSW is authorised to prepare and issue a Notarial Certificate only for documents intended for use outside of Australia. This certification ensures that the documents are legally recognised and accepted in other countries.

What is a Notaial Certificate?

A Notarial Certificate is a formal document that verifies the act undertaken by the Notary Public, such as, has witnessed the signing of a document and confirms the authenticity of the signatures. When a document is notarised for use overseas, it typically must be accompanied by a Notarial Certificate to meet the receiving country’s legal requirements. This certificate includes details such as the date, the Notary’s credentials, and a statement affirming that the signer has been properly identified and what was undertaken by the Notary to complete the notarial act required by the overseas jurisdiction. Attaching a Notarial Certificate is essential as it provides a trusted layer of validation, giving foreign authorities confidence in the document’s legitimacy. For some countries, additional steps, like apostille certification or consular legalisation, may also be required.
